Purpose:

The Better Care Fund is a partnership arrangement between NHS bodies and the Council under section 75 of the National Health Services Act 2006.

The Better Care Fund has been established since 2015 to support the local integration of health and social care and to achieve the National Conditions and Local Objectives set out in the Better Care Fund Plan.

A specific Better Care Fund section 75 agreement has been created with Slough Borough Council and Frimley ICB to ensure clarity on financial management and audit arrangements.

Legal advice stated “As such, a Section 75 Agreement will not require a separate Cabinet Authority and/or Business Case and can be sealed under the authority of an authorised officer in line with the Scheme of Delegation (section 3.6 of the Constitution)…You should still complete a Significant Officer Decision form for this matter given the value of the spend which results from this overarching agreement”
